Version 1, interim terms in force from 2026-07-31, pending final legal review
You authorize a one-time charge of up to your stated maximum, made only if this pool confirms. No money moves while the pool fills, this is not an escrow, and if the truck does not fill you are never charged.
**Pool Purchase Authorization, Hay Pools**
*Version 1. Interim terms in force pending final legal review. A counsel-reviewed version will replace this one, and you will be asked to accept the update.*
By clicking "I agree" and starting or joining a Claim, you ("Buyer")
agree to the following terms governing your share of this pooled
hay load on AgBid (the "Platform"):
1. **What you are buying.** A share of one full truckload of hay
from the grower named on the pool page, in the quantity of
increments you selected. Your share is part of a group purchase:
the load ships as one truck serving multiple delivery stops.
2. **Payment authorization, not escrow.** When you join, your
payment method is saved with our payment processor (Stripe) and
you authorize a single future charge of up to the maximum shown
at checkout (your "Authorized Maximum"). No funds are collected,
held, or escrowed by AgBid or anyone else while the pool fills.
This is an authorization to charge later, nothing more.
3. **The single charge.** If and only if the pool reaches its fill
bar and the grower confirms the load, your payment method is
charged once, for your final ledger amount. Your final amount is
always equal to or less than your Authorized Maximum. Buyers who
join after you reduce your share of the freight, so your final
amount typically falls as the pool fills.
4. **If the pool does not fill.** If the pool closes without
confirming, your authorization is released and you are charged
nothing. There is no cancellation fee, no holding period, and no
refund to wait for, because no money ever moved.
5. **The open ledger.** Every component of your final amount (hay,
your weight-based share of the published freight quote, any stop,
unloading, or Host handling charge, and the AgBid fee) is
itemized on the pool ledger. AgBid's fee is 8 percent of the hay
value only. Freight is passed through to the hauler at exactly
the published quote; AgBid takes no margin on freight.
6. **Failed payments.** If the confirmation charge fails, you have
one hour to fix your payment method from My Pools. If it is not
fixed within the hour, your share is released, you owe nothing,
and the pool recalculates without you. No other buyer pays more
because of a released share.
7. **Delivery, Hosts, and pickup.** Your hay is delivered to the
stop you joined. If you are not the stop's Host, you collect
your bales from the Host's address within 72 hours of delivery.
The Host is a temporary receiver, not a seller, warehouse, or
bailee for hire, and owes only reasonable care (keeping the hay
dry and protected) between delivery and your pickup.
8. **Uncollected hay.** If you miss the pickup deadline, you will
receive reminders at 24 and 48 hours past due. After that your
share may be marked abandoned and the hay relisted on your
behalf or released to the Host, per the policy shown at
checkout. Abandonment never creates a charge for the Host and
never entitles you to a refund of a completed purchase.
9. **Shipping short.** If the grower elects to ship below the fill
bar, the grower absorbs the resulting freight difference. Your
final amount is still computed at fill-bar pricing and still
never exceeds your Authorized Maximum.
10. **Disputes.** Quality or delivery disputes are handled through
AgBid's mediation process, with the lot-traced records and the
pool ledger as the primary evidence. AgBid may issue partial or
full refunds where the evidence supports the claim.
11. **No warranty by AgBid.** AgBid operates the marketplace,
payment rails, ledger, and mediation. AgBid is not the seller
of the hay and does not warrant feed quality or delivery
outcomes beyond the mediation process above.
12. **Changes.** AgBid may update these terms for future pools.
The version you accept today governs this share.
